Do both parties need to be present for marriage registration in Thailand?
In most cases, yes — both parties are required to attend the district office (Amphoe) in person. However, there are limited circumstances where a duly authorised representative may attend on behalf of one party. We assess each situation individually and advise on the most appropriate route based on your nationalities and current documents.
How long does an uncontested divorce take in Thailand?
When both parties are in agreement and the documentation is in order, an uncontested divorce can sometimes be completed at the district office in a single visit, typically within a few days of us completing the paperwork. The timeline depends on document availability and the schedules of all parties. We will give you a realistic estimate once we know your situation.
What grounds are recognised for contested divorce under Thai law?
The Civil and Commercial Code sets out specific grounds, including adultery, serious mistreatment, abandonment, a period of separation, and several others. Courts assess the evidence presented for each ground, and the process requires proper documentation and, in many cases, witness testimony. We discuss which grounds may apply in your particular circumstances during the initial consultation.
Is a prenuptial agreement legally enforceable in Thailand?
Yes, a prenuptial agreement prepared and registered at the time of marriage registration is recognised under Thai law. It must be in writing, signed by both parties and two witnesses, and registered at the district office alongside the marriage. Additional costs such as government filing fees and certified translation charges are discussed and agreed before they are incurred. There are no unexpected additions.
